Title: Judge rules NO WARNING LABELS for premium cigars
Post by: amigodecigars on 02/04/2020 07:17 AM
Very good news..........Warning labels will not be coming to premium cigars.

Earlier today, U.S. District Court Judge Amit P. Mehta ruled in favor of the premium cigar industry in a lawsuit brought against the U.S. Food & Drug Administration (FDA) and its requirements for warning labels on cigars.                          https://cigar-coop.com/2020/02/cigar-news-court-rules-against-fda-on-warning-labels-for-premium-cigars.html (https://cigar-coop.com/2020/02/cigar-news-court-rules-against-fda-on-warning-labels-for-premium-cigars.html)

the interesting conclusion in the decision
'By failing to analyze' whether consumers are in fact misinformed or underinformed as to premium cigar health effects, 'the agency has failed to offer the rational connection between facts and judgment required to pass muster under the arbitrary and capricious standard.'"
basically seemed to say they could not prove that we, as consumers, were not aware of possible health concerns related to cigars.  Wow, that is pretty logical thinking.
Also, just FYI, this judge was appointed by Pres. Obama
